These Terms govern your use of the Trippy app and trippy.social. By using Trippy, you agree to them.
Your account
You sign in with Apple and are responsible for the activity on your account. Keep your device secure. You must be at least 13 years old to use Trippy.
Your content
You retain ownership of the trips, places, and other content you create. You grant us the limited rights needed to store and display that content to you and to the people you choose to share it with. Don't upload content you don't have the rights to, and don't use Trippy to harass others or break the law.
Acceptable use
- No unlawful, abusive, or infringing content.
- No attempts to disrupt, reverse engineer, or gain unauthorized access to the service.
- No scraping or automated collection of other users' data.
Copyright and DMCA
You must own or have the rights to any content you upload — including photos, and the titles, notes, and other text you add to trips and your profile. Do not upload content that infringes someone else's copyright or other rights.
We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on Trippy infringes your copyright, send a written notice to our designated agent at copyright@trippy.socialthat includes: your physical or electronic signature; identification of the copyrighted work claimed to be infringed; identification of the material you say is infringing and information reasonably sufficient to locate it; your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We may remove or disable access to material claimed to be infringing and, in appropriate circumstances, terminate the accounts of repeat infringers. If you believe your content was removed in error, you may send a counter-notification to the same address with the information required by the DMCA, and we will follow the DMCA's counter-notice process.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where applicable consumer-protection law requires otherwise.
Dispute resolution; binding arbitration
Please read this section carefully — it affects your legal rights, including your right to go to court. To the fullest extent permitted by law, you and Trippy agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Trippy will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.
Class-action waiver.You and Trippy agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.
Your right to opt out. You may opt out of this arbitration agreement and class-action waiver within 30 days of first accepting these Terms by emailing hello@trippy.social with your name and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms. If any portion of this section is found unenforceable, the remainder will remain in effect, except that if the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court.
Nothing in this section limits any non-waivable rights you may have under applicable law, and it does not affect the rights described in the Apple App Store terms.
Availability
Trippy is provided "as is". We work to keep it reliable but don't guarantee uninterrupted or error-free service, and features may change over time.
Limitation of liability
To the maximum extent permitted by law, Trippy is not liable for indirect, incidental, or consequential damages arising from your use of the app.
Termination
You may stop using Trippy and request account deletion at any time. We may suspend accounts that violate these Terms.
